1. CONTEST DESCRIPTION: The XLERATOR High-Speed, Energy-Efficient Hand Dryer "MVP Contest," purchase required, is a contest in which entrants must purchase and install at least one XLERATOR unit and submit a one-paragraph essay about the XLERATOR, as detailed below, to be entered into a chance to win the MVP Prize Package.
2. PURCHASE AND ESSAY REQUIRED: Contest is open only to legal U.S. companies and legal U.S. residents who are 18 years of age or older at time of entry, domiciled in Connecticut, Massachusetts, Maine, New Hampshire, Rhode Island, or Vermont, and who complete the entry requirements. Limit one entry per XLERATOR unit purchased and installed during the M.V.P. Contest period, per company, individual, or per address. The MVP Contest begins on 8/2/2010 and ends on 11/30/2010. HOW TO ENTER: Contact your chosen XLERATOR distributor, to arrange for the purchase and installation of at least one high speed, energy efficient XLERATOR hand dryer unit at your facility. Draftees must submit a one paragraph essay about why their organization should be named the XLERATOR MVP, and send it along with your name, address, email, phone number, and proof of purchase to Excel Dryer, Inc., 357 Chestnut Street, P.O. Box 365, East Longmeadow, MA 01028 to be entered in the contest for the MVP Prize Package. WINNER SELECTION: The entrant with the best essay, as determined by an independent judge on 12/1/2010, will be the (1) MVP Contest Winner. Winners will be notified by phone and/or mail by 12/6/2010. ODDS: Odds of winning are dependant on number of entries received. PRIZE: The MVP Contest Winner will be awarded the MVP Prize Package, consisting of a behind the scenes tour of The Hall at Patriot Place presented by Raytheon, Four (4) V.I.P. Pavillion hospitality passes and four (4) tickets to a New England Patriots home game, dinner for four (4) at CBS Scene Restaurant and Bar, and accommodations for four (4) including two rooms for one night at the Renaissance Hotel & Spa at Patriot Place. Approximate Retail Value $4000.00 U.S.D. No prize substitution or cash redemption, except at Excel Dryer, Inc.'s sole discretion. Excel Dryer, Inc. reserves the right to substitute a prize of equal or greater value if advertised prize becomes unavailable. Prizes are not transferable. Winners are responsible for all federal, state, and local taxes, as well as any fees and/or expenses incurred in claiming and using prize. 3. PRIZE CLAIMS: To claim a prize, call 1-800-255-9235 or email sales@exceldryer.com. Winners may be required to execute an affidavit of eligibility and a liability/publicity release, to be returned within 14 days of date notice is sent or prize will be forfeited and may be awarded to an alternate winner. If prize winner cannot be reached by phone or email, or prize notification is returned as undeliverable, prize will be forfeited and may be awarded to an alternate winner. All claimed prizes will be awarded. No more than the advertised number of prizes will be awarded.
4. GENERAL RULES OF PARTICIPATION: Excel Dryer (the "Sponsor"), employees and their respective parent companies, affiliates, contractors, subsidiaries, distributors, sales representatives, retailers, advertising and promotion agencies, and any others engaged in the development, production or distribution of sweepstakes materials, and the immediate families and household members of each of the above, are ineligible. By participation in the MVP Contest, entrant agrees to these rules and the decisions of the Judges, which are final and legally binding in all matters relating to this contest. All entries for the MVP Contest are subject to verification and are void if not obtained in accordance with these Official Rules and through legitimate channels, if any entry is counterfeit, altered, defective, illegible, reproduced, tampered with, mutilated or irregular in any way, or as a result of printing, typographical, mechanical, electronic error, or other errors. Participants assume all risk of loss, damage, destruction, delay, or misdirection of sweepstakes materials/mail submitted to Sponsor. Sponsor and its affiliated companies and agencies are not responsible for printing, distribution, or production errors and may rescind, cancel or revoke this contest based upon any such error without liability and at their sole discretion. All federal, state, and local laws apply. Void where prohibited. Entry constitutes permission to use winner's essay, name, likeness, or both, for advertising or publicity purposes, or both, without further compensation (except where prohibited by law). By participating in this contest, entrants hereby release and agree to hold harmless the Sponsor, NPS LLC, New England Patriots L.P., and each of their affiliates, directors, employees, officers, and agents, including without limitation, their advertising and promotion agencies, from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of prize or participation in any prize-related activities, or while preparing for or participating in and/or traveling to or from any prize related activity. Winners are responsible for their own transportation to and from Gillette Stadium, Patriot Place, and any other location in connection with this contest. As a condition of entering, participant (and parent/legal guardian if participant is a minor) agrees that (1) under no circumstances will participant be permitted to obtain award for, and participant herby waives all rights to claim punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses, (2) all causes of action arising out of or connected with this sweepstakes, or any prizes/discounts awarded, shall be resolved individually, without resort to any form of class action and shall be resolved exclusively by arbitration under rules of the American Arbitration Association; and (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket cost incurred, including costs associated with entering this sweepstakes, but in no event attorney's fees.
